The legal crisis over trade policies in the United States is deepening. Last month, the U.S. Supreme Court ruled that President Donald Trump’s global tariffs were unlawful and canceled them. The decision opens the way for companies to seek refunds from the government and has also led to a complex legal process involving billions of dollars.
The customs duties canceled by the court had generated over $130 billion in revenue for the U.S. government by the end of 2025. However, following the ruling, many companies have filed lawsuits in federal courts to recover the taxes they paid.
The Trump administration requested a delay of up to four months to reconsider the refund lawsuits. This request was denied today by the United States Court of Appeals for the Federal Circuit. Thus, the possibility of further delays has been eliminated.
In a petition filed on behalf of small businesses initiating the lawsuit, it was stated that the administration’s request for a months-long delay was “clearly unreasonable.” The businesses argued that relief not approved by the Supreme Court should not be provided through lower courts.
The decision does not cover Trump’s sector-specific tariffs. However, the annulment of country-based global tariffs has almost caused a surge in refund requests. According to the Liberty Justice Center, which represents small businesses, over 900 refund claims have been filed in federal courts so far.
