Former NetApp CTO wins dismissal of lawsuit after Vast Data deal

A Florida judge has dismissed NetApp’s lawsuit against its former CTO, Jonsi Stefánsson, ruling that the case should be litigated in Iceland due to a mandatory forum selection clause in his employment contract. NetApp had accused Stefánsson of breach of contract and stealing trade secrets after he left the company to form Red Stapler, which was subsequently acquired by Vast Data. The court found that Stefánsson’s employment agreement and a proprietary information agreement needed to be read together, with the Icelandic jurisdiction clause taking precedence.
